Ministerial Decree
On the Establishment and Function of the
Inclusive Education Center

Minister of Education
issues Decree as follows:
Section I
General Provision

Article 01:        Purpose:
                        The purpose of this Decree is to define the location, roles, mandate, rights, organizational structure, staff and the mechanism of working of the “Inclusive Education Center” to function and realize the tasks on promoting education for women, ethnic and disabled people as planned for each Education Plan period.

Article 02:        Location and roles:
                        The Inclusive Education Center (with abbreviation of IEC) is an administrative body of the Ministry of Education administration and management to manage tasks on promoting the inclusive education of the macro level of the entire country. The Inclusive Education Center plays a catalytic and leading role for the Ministry of Education on the administration of the promotion of education for women, girls, ethnic and disabled people, and people with special needs  to ensure their access to universal education, As well as to strengthening the gender equality in education.

Section II
Roles and Rights

Article  03:       Roles:

    1. Translate the policy on gender equality, girls, ethnic, disabled people and people with special needs into strategies and to make sure educators at every level both public and private put these into effective practice.
    2. Develop specific policy guidelines to provide and promote education for women, girls, ethnic, disabled, people with special needs and other target groups.
    3. Conduct issue-based research and analysis on the promotion of education for women, girls, ethnic, disabled people and people with special needs to universalize access to equal and quality education.
    4. Strengthen human resource capacity on mainstreaming gender equality perspectives into curriculum development and the teaching and learning process at all levels and fields, and to the whole education system.
    5. Coordinate with the technical departments and concerned agencies at national and local levels in implementing the inclusive education to the target groups to ensure the achievement of EFA by 2015.
    6. Collect, disseminate and provide information to promote inclusive education through the country and abroad under the authority of the Ministry.
    7. Enlarge network and collaborate with the technical departments and concerned agencies to provide and promote the inclusive education to every the target group.
    8. Supervise and collaborate with concerned agencies on mainstreaming gender equality in education, and to ensure that the curricular and teaching and learning materials are responsive to the concerns and needs of women, ethnic, girls, disabled people and people with special needs.
    9. Collaborate with the Department of Personnel and other concerned agencies for human resource development to increase the number of female and ethnic staff at every level.  
    10. Collaborate with the Education Quality Assurance Center to identify specific standard to promote inclusive education to ensure the universal access education.
    11. Coordinate with the Statistic-Technology-Education Information Center on conducting  surveys and collection of data on ethnic groups by sex, disability and special needs for planning and developing relevant activities for every Education Plan period.
    12. Supervise and manage the ethnic boarding schools that are under the responsibility of the Ministry of Education and monitor the boarding schools that are under the Provincial Education Services.
    13. Implement the cooperative projects to promote education for women, girls, ethnic and disabled people and people with special needs in accordance with the Ministry of Education mandates.
    14. Advocate, disseminate, supervise, encourage and monitor education sector on implementing the government constitution, policies, laws, decrees and regulations; and the international conventions related to the rights of the child and the advancement of women.
    15. Implement other missions according to the Minister of Education mandates.

Article  04:       Scope of Rights:

  1. Implement strategies, master plans and programmes on promoting inclusive education that are adopted and enforced by the Government.
  2. Analyze programmes, projects, activities and promotion of career and position for women and ethnic staff that relate to the promotion of inclusive education to ensure the universal access education.
  3. Request the official authorization in applying principles, regulations, orders and decrees on promoting inclusive education and to implement the activities of the Center.
  4. Coordinate and cooperate with concerned agencies in monitoring and assessing of progress of promoting women’s advancement and the promotion of inclusive education.
  5. Participate, encourage and monitor, assess the revision and development of the new curriculum to ensure the contents related to promote inclusive education are properly mainstreamed.
  6. Participate in all meetings, seminars, trainings, workshops and exchange experiences related to inclusive education organized by domestic and international agencies in accordance with the agreement and approval of the Ministry of Education.
  7. Collaborate with concerned departments, centers, institutions, provincial educational services/Vientiane Capital Education Services to dialogue and share lessons learned, monitor and provide data and information related to the promotion of the inclusive education.
  8. Propose and collaborate with the Department of Personnel to allocate appropriate positions for personnel of the Center, and to nominate, deploy, promote, transfer, demote and award personnel.
  9. Implement other missions in accordance with the direction of the Minister of Education.

 

Section III
Organization Arrangement and Personnel
 “Center for Promoting Education for Women-Ethnic-Disabled Peoples”

Article 05:        Organization Arrangement of the Center:
            The Center for Promotion and Education of Women-Ethnic-Disabled People” consists of 4 Divisions as follows:
1.         Division of Administration
2.         Division of Education for Children with Special Needs
3.         Division of Ethnic Education
4.         Division of Gender Equality in Education

Article 06:        Personnel Arrangement:
1.         Director General of the Center                                               1 position
2.         Deputy Director of the Center                                                2 positions
3.         Head of Division                                                                     4 positions
4.         Deputy Head Division                                                             4 positions
5.         Technical Staff                                                                       16 positions
that included:
1). Division of Administration                                                  4 positions
         2). Division of Education for Children with Special Needs     4 positions
         3). Division of Ethnic Education                                             4 positions
            4). Division of Gender Equality in Education                         4 positions
                                                                                                            Total:   27 positions                            
Chapter IV
Working Mechanism

Article 07:        Work Procedure:

    1. Implement the principle of unity and democracy, agreed by the team; delegate task for individual responsibility and apply the system of single leader; strengthen creative participation of the personnel to contribute to the administration and development of inclusive education.
    2. Work should be based on the plan, programme and project; identify or implement tasks with focus, centralization and targeting for every education development period.
    3. Manage and administrate missions vertically line while keeping links with the local grassroots levels, and cooperate with local organization and other sectors to ensure using the power of partners to develop and promote the inclusive education.
    4. Work should be monitored, audited, supervised to draw lesson learned to identify the outcomes for every education planning period.
    5. Apply meeting-based, strict on report and feedback, and report regularly to the Minister of Education.

Chapter V
Final Provision

Article 08:        Budget and Seal:
                        The budget serves the Center is from the administration budget category of the Ministry of Education; also supported from the social organizations and other partners both public and private that are being in-country and overseas. The Inclusive Education Center has its own seal for official documents.

Article 09:        Immediate task:
Hand-over the authority to the Inclusive Education Center to investigate and draft its own Working Handbook and propose for official use; and to propose the appointment of personnel in occupying the positions of Head Divisions and Deputy Head Divisions; recruit and deploy technical personnel in the relevant and appropriate positions.

Article 10:        Implementation:
The cabinet, departments, universities, centers, provincial education services, district education bureaus, schools, village education development committee, pupil-parent association and education foundations; and local governors and other concerned parties must recognize and implement effectively this Decree.

Article 11:        Force:
This agreement comes into force from the date of its signing.
